German court: No student right to pray in school (AP)

BERLIN ? Germany's top administrative court has ruled that students don't have the right to pray while in school if a conflict is created.

The court on Wednesday upheld a decision by a lower court which had denied that right to a Muslim student who had demanded a private prayer room at his Berlin high school.

The Federal Administrative Court in Leipzig said while the decision did not prohibit students in general from praying during breaks, the Berlin student did not have a right to pray.

The court said praying should be banned if the religious act can cause religious conflicts at the school ? which it said was the case at the Berlin school. The court also said the creation of a separate prayer room would go beyond the capacities of the Berlin school.

An unexpected player in a cancer defense system

ScienceDaily (Nov. 28, 2011) ? Researchers of Karolinska Institutet and the University of Cologne, Germany, have identified a new protein involved in a defense mechanism against cancer. The VCP/p97 complex is best known for its role in protein destruction and is involved in a type of familial dementia and ALS. In a novel study the researchers now describe how this complex also plays an important role in regulating the recruitment of the tumor suppressor protein 53BP1 to damaged DNA -- suggesting an important role for VCP/p97 in our body's defense against cancer.

Damage of DNA is potentially very dangerous and linked to the development of cancer. Since DNA damage is unavoidable, our cells are equipped with a sophisticated defense system that activates repair mechanisms. This process is initiated by binding of sensor proteins to the damaged DNA that in turn bind and activate other proteins responsible for repairing the damage. During the last decade, it has become clear how many of those proteins are recruited to the damaged DNA, but the mechanism by which the tumor suppressor 53BP1 finds its way has been puzzling.

The surprising finding of this study, presented in the scientific journal Nature Structural & Molecular Biology, is not only the identity of the new player but also how it is doing the job. By following proteins in cells with DNA damage, the researchers found that the VCP/p97 complex is among the proteins that are being recruited to DNA damage. This was unanticipated since VCP/p97 is known to be primarily involved in the destruction of defective proteins. VCP/p97 is doing this by unwinding them so that the waste proteins can be chopped in pieces by dedicated enzymes. This important function also explains its involvement in a type of familial dementia and ALS since this kind of waste proteins typically pile up in these diseases.

It turns out that VCP/p97 is doing something similar at damaged DNA although with a very different outcome. The work shows that VCP/p97 facilitates the binding of 53BP1 by removing a protein that occupies the places where 53BP1 can bind. So instead of unwinding a protein to prepare it for destruction, VCP/p97 pulls a protein out of the way for 53BP1. The researchers also show that worms that have less of this complex are very sensitive to DNA damage supporting an important and evolutionary conserved role of VCP/p97 in DNA damage control. This new mechanism of recruiting a protein by removing another one that gets in the way sheds new light onto how the tumor suppressor 53BP1 finds damaged DNA. An important question that remains is if VCP/p97 plays similar roles in other processes.

Pakistan PM: No more 'business as usual' with U.S. (Reuters)

ISLAMABAD (Reuters) ? Pakistan's prime minister ruled out "business as usual" with the United States on Monday after a NATO attack killed 24 Pakistani soldiers and the army threatened to curtail cooperation over the war in Afghanistan.

Saturday's incident on Pakistan's border with Afghanistan has complicated U.S. attempts to ease a crisis in relations with Islamabad and stabilize the region before foreign combat troops leave Afghanistan.

"Business as usual will not be there," Prime Minister Yusuf Raza Gilani told CNN when asked if ties with the United States would continue. "We have to have something bigger so as to satisfy my nation."

While the NATO strike has shifted attention from what critics say is Islamabad's failure to go after militants, Gilani's comments reflect the fury of Pakistan's government and military - and the pressure they face from their own people.

"You cannot win any war without the support of the masses," Gilani said. "We need the people with us."

The relationship, he said, would continue only if based on "mutual respect and mutual interest." Asked if Pakistan was receiving that respect, Gilani replied: "At the moment, not."

Gilani's comments cap a day of growing pressure from the Pakistani military, which threatened to reduce cooperation on peace efforts in Afghanistan.

"This could have serious consequences in the level and extent of our cooperation," military spokesman Major General Athar Abbas told Reuters.

Pakistan has a long history of ties to militant groups in Afghanistan so it is uniquely positioned to help bring about a peace settlement, a top foreign policy and security goal for the Obama administration.

Washington believes Islamabad can play a critical role in efforts to pacify Afghanistan before all NATO combat troops pull out in 2014 and it cannot afford to alienate its ally.

U.S. national security officials met at the White House on Monday to discuss Pakistan following the weekend incident, which prompted Pakistan to shut down NATO supply routes into Afghanistan in retaliation and which was the worst of its kind since Islamabad allied itself with Washington in 2001.

"We have been here before. But this time it's much more serious," said Farzana Sheikh, associate fellow of the Asia program at Chatham House in London.

"The government has taken a very stern view. It's not quite clear at this stage what more Pakistani authorities can do, apart from suspending supplies to NATO forces in Afghanistan."

The weekend attack was the latest perceived provocation by the United States, which infuriated and embarrassed Pakistan's powerful military in May with a unilateral special forces raid that killed al Qaeda leader Osama bin Laden.

CHINA AND RUSSIA VOICE CONCERN

Adding a new element to tensions and giving a diplomatic boost to Islamabad, China said it was "deeply shocked" by the incident and expressed "strong concern for the victims and profound condolences for Pakistan."

Russia, seeking warmer relations with Pakistan as worry grows over the NATO troop pullout in Afghanistan, said it was "unacceptable" to violate the sovereignty of states even when hunting "terrorists."

U.S. State Department spokesman Mark Toner said Pakistan was rethinking whether to attend next week's conference on Afghanistan in Bonn, Germany, although Washington had not yet received any definitive decision from the Pakistanis.

"We understand that they are reconsidering," Toner told reporters. "We hope that they do in fact attend this conference because this is a conference about ... building a more stable and prosperous and peaceful Afghanistan and so that is very much in the interests of Pakistan."

On Saturday, NATO helicopters and fighter jets attacked two military outposts in northwest Pakistan, killing the 24 soldiers and wounding 13, the army said.

NATO described the killings as a "tragic, unintended incident." U.S. officials say a NATO investigation and a separate American one will seek to determine what happened. The U.S. investigation will provide initial findings by Dec. 23, military officials said.

"It is very much in America's national security interest to maintain a cooperative relationship with Pakistan because we have shared interests in the fight against terrorism, and so we will continue to work on that relationship," White House spokesman Jay Carney told reporters.

A Western official and an Afghan security official who requested anonymity said NATO troops were responding to fire from across the border at the time of the incident.

Pakistan's military denied NATO forces had come under fire before launching the attack, saying the strike was unprovoked and reserving the right to retaliate.

Abbas, the military spokesman, said the attack lasted two hours despite warnings from Pakistani border posts.

"They were contacted through the local hotline and also there had been contacts through the director-general of military operations. But despite that, this continued," he said.

After a string of deadly incidents in the largely lawless and confusing border region, NATO and Pakistan set up the hotline that should allow them to communicate in case of confusion over targets and avoid "friendly fire."

Both the Western and Pakistani explanations are possibly correct: that a retaliatory attack by NATO troops took a tragic, mistaken turn in harsh terrain where differentiating friend from foe can be difficult.

An Afghan Taliban commander, Mullah Samiullah Rahmani, said the group had not been engaged in any fighting with NATO or Afghan forces in the area when the incident took place. But he added that Taliban fighters control several Afghan villages near the border with Pakistan.

A similar cross-border incident on Sept. 30, 2010, which killed two Pakistani service personnel, led to the closure of one of NATO's supply routes through Pakistan for 10 days.

OBAMA EFFIGY BURNED

The main Pakistani association that delivers fuel to NATO forces in Afghanistan said it would not resume supplies soon in protest against the NATO strike.

In the Mohmand region, where the attack took place, hundreds of angry tribesmen yelled "Death to America." About 200 lawyers protested in Peshawar city, some burning an effigy of U.S. President Barack Obama.

Pakistani editorials were strident. "We have to send a clear and unequivocal message to NATO and America that our patience has run out. If even a single bullet of foreign forces crosses into our border, then two fires will be shot in retaliation," said one mass-circulation Urdu language paper.

Pakistan joined the U.S.-led war on militancy launched after al Qaeda's attacks on the United States on Sept. 11, 2001, and has won billions of dollars in aid in return.

But the unstable, nuclear-armed country has often been described as an unreliable ally and the United States has resorted to controversial drone aircraft strikes against militants on Pakistani territory to pursue its aims.

U.S. Senator John McCain, a leading voice of Republicans on military issues, echoed frustration in Washington when he said the loss of life was "tragic" but that Pakistani intelligence still supported militants fueling violence in Afghanistan.

"Certain facts in Pakistan continue to complicate significantly the ability of coalition and Afghan forces to succeed in Afghanistan," he said.

Safety oversight of gov't aircraft lacking (AP)

WASHINGTON ? Nonmilitary government agencies operate more aircraft than the world's largest airline but are subject to little federal safety oversight ? a situation accident investigators say has contributed to air crashes and deaths.

Federal, state and local agencies own or lease more than 2,400 nonmilitary planes and helicopters for fighting forest fires, chasing crooks, conducting scientific research and other tasks. By comparison, the world's largest airline ? created by the merger of United and Continental ? and its regional carriers operate fewer than 1,300 planes.

But unlike United, Continental and other commercial airlines, government agencies are mostly left to police the safety of their flight operations themselves. The Federal Aviation Administration has long said it doesn't have the authority to apply regulations to other government agencies.

From 2000 through the first eight months of this year, the National Transportation Safety Board investigated at least 349 accidents, resulting in 135 deaths, involving aircraft owned by or operated under contract for government agencies. Problems uncovered in some of those accidents have prompted the board to host a forum beginning Wednesday aimed at getting the FAA and other government officials to discuss ways to address the problem.

"The issue for us is who is responsible (for safety). We have cases now where we ask that question and no one seems to know," said Tom Haueter, director of NTSB's office of aviation safety.

The NTSB isn't the only one confused. John Allen, the head of the FAA's flight standards, told a gathering of private and public aviation officials earlier this year that even his inspectors are sometimes uncertain of their role.

FAA officials have asked Congress to clarify the situation but the request "isn't a high priority," Allen said.

Part of the problem is that safety regulations written with commercial and private aviation in mind don't address government operations that are sometimes inherently risky.

"They're landing on dirt strips out in the middle of nowhere. They're shooting coyotes from the air. ... Some of the stuff is really kind of intense flying. If you're down low enough for a guy to shoot a coyote, that's pretty low," Haueter said.

Assigning responsibility for safety oversight becomes even murkier when private contractors operate flights for government agencies, an increasingly common occurrence.

The FAA published new guidance for government agencies and contractors in March, but safety investigators and contractors said there are still many gray areas.

The NTSB forum was spurred in part by the agency's two-year investigation of the August 2008 crash of a firefighting helicopter near Weaverville in Northern California. Nine people were killed and four others injured. The company that operated the flight misrepresented the performance capabilities of its helicopters in order to win a U.S. Forest Service firefighting contract, and then gave misinformation to its own pilots, causing them to underestimate the aircraft's weight, NTSB's investigation found.

The board faulted the Forest Service for not ensuring the helicopter operator was following safety regulations as promised in its contract. It also faulted the FAA, whose inspectors checked the safety of aircraft the contractor used for nongovernment work, but ignored helicopters used for government assignments.

Other accidents that have raised concern:

? A New Mexico state police helicopter crashed while attempting to rescue a lost hiker near Santa Fe, N.M., in June 2009. The pilot and the hiker were killed and a highway patrolman seriously injured. State police placed greater importance on completing missions than on making certain they were carried out safely, the board said. The agency also didn't employ enough pilots to safely operate around the clock, which indirectly put pressure on pilots to fly missions despite not having had enough rest.

? A Maryland state police medical evacuation helicopter crashed at night in poor weather while attempting to transport two auto accident victims in September 2008. The pilot, two medical workers and one of the accident victims were killed. The second accident victim was severely injured. The board questioned the agency's decision to dispatch the helicopter, saying police should have assessed the potential risks first.

Cases like the Weaverville accident involving a deliberate disregard for safety are rare, said Matt Zucarro, president of Helicopter Association International, whose members include government contractors.

"If you look at (contractor) aircraft performing government operations, the civilian ones, as well as government-operated aircraft, they have a very good safety record," Zucarro said. "Generally the operators have their standards and they aren't going to mitigate or diminish them because they get a request from a government agency for something."

FAA inspectors may not have the authority to demand safety information from contractors whose work for the Defense Department is classified secret, Allen told contractors at the meeting, which was hosted by the helicopter association.

"You are seeing more and more contracting in support of government services," he said. "The regulatory framework is slow to catch up."

Allen cited the example of a contractor transporting special forces troops in Afghanistan who was asked by the military to carry cargo containing ammunition on the plane as well. FAA regulations don't permit ammunition on passenger-carrying aircraft.

"You need to educate your air crews not to be enticed to operate outside the regulations in the heat of battle," he warned.

One of the year's best films, a bubbly meditation on family and responsibility that weighs just enough to matter.

With so many balls in the air the temptation is to rush from one plot strand to another, but Payne takes the opposite approach. He also captures the complexity of emotional reactions that grief stirs.

It's a lovely, heartfelt character study of common, everyday people trapped on the horns of an uncommon but not unheard-of dilemma.

The latest exhibit in Payne's careful dissection of the beached male, which runs from Matthew Broderick's character in "Election" to Jack Nicholson's in "About Schmidt" and Paul Giamatti's in "Sideways."

This mature, well-acted dramatic comedy is deeply satisfying, maybe even cathartic.

A tough, tender, observant, exquisitely nuanced portrait of mixed emotions at their most confounding and profound -- all at play within a deliciously damp, un-touristy Hawaii that's at once lush and lovely to look at.

The Descendants is a wonderful film, full of nuance and beleaguered humanity.

A large patch of the movie's social contract are the Hawaiian notions of 'aina, malama and pono. It joins the short list we aren't embarrassed to screen for malahini.

A heartbreaking story with satisfying emotional payoffs, and truly beautiful Hawaiian photography.

George Clooney and Shailene Woodley are terrific as lost-soul dad and old-soul daughter in Alexander Payne's funny, thoughtful film.

Marked by stellar performances and an incisive screenplay, The Descendants packs a real Hawaiian punch.

The best thing here is Clooney, cleverly dropping some of his man's man mannerisms to make Matt less of an idea and more of a human.

It's smart, funny, heartbreaking, heartwarming, wise, and, despite some sad moments, genuinely optimistic. I experienced more feelings watching it than I usually get from ten movies.

Well-acted and touching with a mild eye for human foibles, this is one of the better-written films of the year.

What's so special about Payne's approach in The Descendants is how acutely observed and subtle the movie is, especially since the previews are selling it as a broader, more absurd comedy.

If you see The Descendants, see it for Clooney (and Woodley), but don't believe the hype that it's one for the ages.

A lot of The Descendants is affecting, but its mushier tone is often less emotionally resonant than the bitter sarcasm of Payne's earlier work.

This unforgettable movie succeeds by making audiences feel like a part of the family. Clooney knocks it out of the park with a marvelous performance. Woodley makes a strong bid for a supporting actress nomination. The supporting players are all given...

Here's where I am right now: The Descendants is the best movie of 2011. It is the movie of the year, in many ways beyond its simple superlative overall excellence.

(Clooney) is at the top of his game in his scenes alone with the comatose Elizabeth. Asking questions that are unable to be answered, his pain at his loss and her betrayal is heartbreaking.

Audiences will argue about whether it's a comedy or a drama, but they'll agree they saw a wonderful film.

The Descendants finds Payne, now 50, having arrived in midlife with a new maturity, eschewing solipsism and snickers for a deeper engagement with the world.

Clooney has never been better, displaying more range and less actor-ego than ever before... The Descendants would still be a splendid movie without him; with Clooney, it's one of 2011's very best.

The BBC reported that he 265-foot Swanland sent out a mayday call at around 2 a.m. local time (9 p.m. ET), when it was about 30 miles northwest of the Llyn peninsula in Wales.

Two male crew members were later rescued from the water.

Britain's Sky News quoted a coast guard spokeswoman as saying that the vessel had suffered a "cracked hull." She described the sea conditions in the area as "challenging at best." Gale-force winds were also reported.

The BBC reported that rescuers arriving at the scene found "two life rafts and some floating debris."

The ship was reportedly carrying 3,000 tons of limestone.

The rescue operation was launched from RAF Valley, the UK air force base where Prince William is based. He serves as a search-and-rescue helicopter pilot. However, it was not immediately clear whether he was on duty this weekend.

Egypt's ElBaradei willing to head cabinet: statement (Reuters)

CAIRO (Reuters) ? Egyptian presidential candidate Mohamed ElBaradei is prepared to drop his bid to be head of state if he is asked to lead a transition government to steer the country to civilian rule, his campaign team said on Saturday.

ElBaradei is offering himself as an alternative to Kamal Ganzouri, a veteran politician named by the country's ruling military council on Friday to head a new interim government after a week of protests and violence that has killed 42 people.

The cabinet of Prime Minister Essam Sharaf resigned last week as the clashes spread.

On Saturday, Egyptians protesting against the appointment of 78-year-old Ganzouri, who served as Prime Minister in the 1990s under ousted President Hosni Mubarak, clashed with police firing tear gas in central Cairo.

ElBaradai's announcement stepped up pressure on the military council to drop its candidate for the top job and turn over more powers to civilians.

ElBaradei himself is respected among pro-democracy campaigners but many Egyptians view him as out of touch because he spent much of his career outside the country, particularly during his time at the head of the U.N. nuclear watchdog.

The flare-up of violence has cast another shadow over a parliamentary election that begins on Monday and has been billed as the nation's first free vote in decades.

ElBaradei's campaign team said he met with revolutionary youth coalitions and political parties who had rejected Ganzouri's appointment.

"The political forces and groups stressed that the only way out of the crisis is to form a national coalition government with full powers to manage the transitional period until presidential elections are held," ElBaradei's team said in a statement.

It said he would abandon his bid for the presidency if he were asked formally to form a government, "so as to be completely neutral in the interim period."

ElBaradei's office said earlier on Saturday that he had been in touch with the military council to discuss "the demands of the revolution," without reaching agreement. He also met with political groups.

Two days of voting are due to begin on Monday in the first stage of a complex, drawn-out election to parliament's lower house that will be completed in January. Voting for the upper house and the presidency will follow before the end of June.

Alarmed by the violence in Cairo and other cities, the United States and the European Union have urged a swift handover to civilian rule in a country where prolonged political turmoil has compounded economic woes.

Clean air, water rules spark different responses (AP)

WASHINGTON ? Large and small companies have told Republican-led congressional committees what the party wants to hear: dire predictions of plant closings and layoffs if the Obama administration succeeds with plans to further curb air and water pollution.

But their message to financial regulators and investors conveys less gloom and certainty.

The administration itself has clouded the picture by withdrawing or postponing some of the environmental initiatives that industry labeled as being among the most onerous.

Still, Republicans plan to make what they say is regulatory overreach a 2012 campaign issue, taking aim at President Barack Obama, congressional Democrats and an aggressive Environmental Protection Agency.

"Republicans will be talking to voters this campaign season about how to keep Washington out of the way, so that job creators can feel confident again to create jobs for Americans," said Joanna Burgos, a spokeswoman for the House Republican campaign organization.

The Associated Press compared the companies' congressional testimony to company reports submitted to the Securities and Exchange Commission. The reports to the SEC consistently said the impact of environmental proposals is unknown or would not cause serious financial harm to a firm's finances.

Companies can legitimately argue that their less gloomy SEC filings are correct, since most of the tougher anti-pollution proposals have not been finalized. And their officials' testimony before congressional committees was sometimes on behalf of ? and written by ? trade associations, a perspective that can differ from an individual company's view.

But the disparity in the messages shows that in a political environment, business has no misgivings about describing potential economic horror stories to lawmakers.

"As an industry, we have said this before, we face a potential regulatory train wreck," Anthony Earley Jr., then the executive chairman of DTE Energy in Michigan, told a House committee on April 15. "Without the right policy, we could be headed for disaster."

The severe economic consequences, he said, would be devastating to the electric utility's customers, especially Detroit residents who "simply cannot afford" higher rates.

Earley, who is now chairman and CEO of Pacific Gas & Electric Corp., said if the EPA had its way, coal-fired plants would be replaced with natural gas ? leading to a spike in gas prices. He said he was testifying for the electric industry, not just his company.

But in its quarterly report to the SEC, Detroit-based DTE, which serves 3 million utility customers in Michigan, said that it was "reviewing potential impacts of the proposed and recently finalized rules, but is not able to quantify the financial impact ... at this time."

Skiles Boyd, a DTE vice president for environmental issues, said in an interview that the testimony was meant to convey the potential economic hardship on ratepayers ? while the SEC report focused on the company's financial condition.

"It's two different subjects," he said.

Another congressional witness, Jim Pearce of chemical company FMC Corp., told a House hearing last Feb. 9: "The current U.S. approach to regulating greenhouse gases ... will lead U.S. natural soda ash producers to lose significant business to our offshore rivals...." Soda ash is used to produce glass, and is a major component of the company's business..

But in its annual report covering 2010 and submitted to the SEC 13 days after the testimony, the company said it was "premature to make any estimate of the costs of complying with un-enacted federal climate change legislation, or as yet un-implemented federal regulations in the United States." The Philadelphia-based company did not respond to a request for comment..

California Rep. Henry Waxman, the senior Democrat on the House Energy and Commerce Committee, said the SEC filings "show that the anti-regulation rhetoric in Washington is political hot air with little or no connection to reality."

House Republicans have conducted dozens of hearings, and passed more than a dozen bills to stop proposed environmental rules. So far, all the GOP bills have gone nowhere in the Democratic-run Senate.

"I will see to it, to the best of my ability, to try to stop everything," California Sen . Barbara Boxer, the Democratic chairman of the Senate's environment committee, vowed in reference to GOP legislation aimed at reining in the EPA. She predicted Republicans "will lose seats over this."

The Obama administration has reconsidered some of the environmental proposals in response to the drumbeat from business groups. In September, the president scrubbed a clean-air regulation that aimed to reduce health-threatening smog. Last May, EPA delayed indefinitely regulations to reduce toxic pollution from boilers and incinerators.

James Rubright, CEO of Rock-Tenn Co., a Norcross, Ga.-based producer of corrugated-and-consumer packaging, told a House panel in September that a variety of EPA, job safety and chemical security regulations would require "significant capital investment" ? money that "otherwise go to growth in manufacturing capacity and the attendant production of jobs."

Rubright conveyed a consulting firm's conclusion that EPA's original boiler proposal before the Obama administration withdrew it in May would have cost the forest products industry about $7 billion, and the packaging industry $6.8 billion.

Another industry study, he said, warned that original boiler rule would have placed 36 mills at risk and would have jeopardized more than 20,000 jobs in the pulp and paper industries ? about 18 percent of the work force.

But a month before his testimony_ and three months after EPA withdrew its boiler proposal ? Rock-Tenn told the SEC that "future compliance with these environmental laws and regulations will not have a material adverse effect on our results or operations, financial condition or cash flows." The company did not respond to a request for comment.

Fans of USA's Covert Affairs know that Annie Walker's stomping ground is Washington DC, where she pretends to be a buyer for the Smithsonian. So, there are only two plausible explanations for her iPhone 4 being able to connect to Rogers Wireless Canadian network: Either she's got a nuclear powered antenna on that thing, or the company is running a south-of-the-border service for Government agencies. Some might point out that the show is filmed in Toronto for cost purposes and the art directors aren't too hot at spotting continuity errors, but we'd dismiss that as paranoid fantasy.
